Abstract

Abstract In construction disputes, resolution often hinges not only on the strength of legal arguments but also on the persuasive power of numbers, figures that are frequently complex, contested, and highly consequential. Within this landscape, quantum expert witnesses—independent professionals appointed to analyze, quantify, and provide expert testimony on measurable aspects of a dispute—have emerged as indispensable actors, serving as interpreters of financial reality through the application of rigorous quantitative analysis to untangle the intricate web of losses and damages. This research examines the pivotal role played by such experts, emphasizing that tribunals rely on quantum evidence not merely for its capacity to deliver numerical precision but also for the narrative coherence it brings to the presentation of complex claims. An examination of existing literature illustrates that well-structured and carefully reasoned quantum reports substantially enhance the persuasiveness of a party’s position, whereas poorly presented analyses can weaken, and in some instances even undermine, otherwise strong claims. The findings further indicate that the most influential quantum experts are those who combine technical accuracy with clarity of communication, enabling tribunals to transform abstract financial data into concrete and actionable findings. At the same time, the study reveals an inherent tension in the process: while tribunals naturally seek certainty in their determinations, the practice of quantum assessment necessarily involves elements of judgment and assumption, rendering the expert’s credibility just as crucial as the methodology employed. Ultimately, the paper reframes the role of quantum expert witnesses as that of architects of clarity—professionals who translate numerical complexity into accessible understanding, transforming silent figures into decisive voices within the arena of international construction disputes.
